General Rental Terms for the Holiday Apartments "Ferienwohnungen "Am Stausee"
1. Conclusion of Contract
The rental contract for the holiday apartment becomes binding when the booking confirmation/invoice is received by the tenant. The holiday apartment is rented to the tenant exclusively for vacation purposes for the agreed-upon period and may only be occupied by the agreed number of persons.
2. Rental Price and Additional Costs
The agreed rental price includes all flat-rate additional costs, except for the final cleaning fee, which will be charged separately.
3. Rental Duration and Inventory
- Arrival: The rental property will be made available to the tenant on the day of arrival from 3:00 PM in proper condition. If the arrival is after 6:00 PM, the tenant is required to inform the landlord in advance.
- Inventory Check: Upon arrival, the tenant is requested to immediately check the inventory list for completeness and report any shortages to the landlord by the following day at the latest.
- Departure: On the day of departure, the tenant must vacate the rental property by 10:00 AM at the latest and leave it in a broom-clean condition.
4. Cancellation by the Tenant
The tenant may cancel the rental agreement before the rental period begins by submitting a written declaration to the landlord. The time of receipt of the cancellation notice by the landlord is decisive. In case of cancellation, the tenant is required to pay a flat-rate compensation for the expenses already incurred by the landlord and the lost profit in the following amounts:
- Cancellation up to 30 days before the start of the rental period: 60% of the rental price
- Cancellation after the 30th day and in case of no-show: 100% of the rental price
We recommend taking out travel cancellation insurance.
5. Termination by the Landlord
The landlord may terminate the rental agreement before or after the rental period begins without notice if the tenant fails to make the agreed payments (advance payment, balance payment, etc.) despite prior reminders, or behaves in such a manner that it is unreasonable for the landlord to continue the contractual relationship. In such a case, the landlord may claim compensation for the expenses incurred up to the termination and for lost profits.
6. Termination of the Contract Due to Exceptional Circumstances
Both parties may terminate the rental agreement if the fulfillment of the contract is significantly hindered, jeopardized, or impaired due to unforeseeable higher force (e.g., natural disasters, political unrest). Both parties are released from their contractual obligations, but any services already rendered must be reimbursed.
7. Pet Ownership
Pets (especially dogs, cats, etc.) may only be kept and temporarily housed with the explicit permission of the landlord. Permission is granted on a case-by-case basis and can be revoked if any inconvenience arises. The tenant is responsible for all damages caused by pet ownership.
The tenant agrees to vacuum the holiday apartment daily and to keep the green areas clean.
